Preamble

The present Preamble is an integral part of the General Terms and Conditions of Sale.

Article 1. Parties to this Act

Between the undersigned:
1° The Company FEED, a simplified joint stock company with a capital of 13,335 euros, registered with the Paris Trade and Companies Register under number 821 239 878, whose registered office is located at 231 rue Saint Honoré, 75001 Paris, and whose VAT number is FR59821239878. Hereinafter referred to as the "Seller",
On the one hand, And 2° Any natural person wishing to make a purchase on the Seller's website.
Hereinafter referred to as the "Buyer",
On the other hand, It has been exposed and agreed as follows:

Article 2. Subject

The Seller's activity includes the production and online sale of "smart food" products (hereafter "the Product") that provide an alternative to "traditional" food. The Buyer and the Seller agree that their relationship as well as access to and use of the www.feed.co website (hereinafter "the Site") shall be governed exclusively by :
- The present General Terms and Conditions of Sale, to the exclusion of any other conditions and that they will prevail, if necessary, over any other version or any other document
- The Privacy Policy
- The Legal Notice
- The applicable laws and/or regulations.

The General Terms and Conditions of Sale, the Privacy Policy and the Legal Notice of the Site are made available to consumers on the Vendor's Site where they can be directly consulted. The Privacy Policy (here) and the Legal Notice (here) are an integral part of these Terms and Conditions of Sale. The acquisition of a Product on the Seller's site implies the knowledge and acceptance without reservation by the Buyer of these General Terms and Conditions of Sale in force on the day of the order, whose conservation and reproduction are ensured by the Seller. Each Buyer undertakes to respect the destination of the Site and not to make a use aiming to divert it from its purpose of selling Products online. The Seller reserves the right to modify its General Terms and Conditions of Sale at any time. In the event of modification, the applicable General Terms and Conditions of Sale are those in force at the date of the order by the Buyer, a dated copy of which may be given to him at his request. The fact that the Seller does not claim the application of any clause of the General Terms and Conditions of Sale or agrees to its non-performance, whether permanently or temporarily, shall not be interpreted as a waiver by the Seller of the rights arising for him from the said clause. These General Terms and Conditions of Sale were updated on 13 June 2019. This edition cancels and replaces the previous versions.

Article 3. Definitions

3-1. Seller : refers to the Société par actions simplifiée FEED. with capital of 13,335 euros, registered with the Paris Trade and Companies Registry under number 821 239 878, whose registered office is located at 231 rue Saint Honoré, 75001 Paris, and whose VAT number is FR59821239878.
3-2. Buyer : refers to any individual wishing to make a purchase on the Site
3-3. Product : designates any product offered on the Site, within the limits of available stocks. The photographs cannot ensure a perfect similarity with the product offered.
3-4. Delivery : designates the transfer to the Buyer of physical possession or control of the Product.
3-5. Site : designates the infrastructure developed by the Vendor according to the computer formats that can be used on the Internet, including data of various kinds, and in particular texts, sounds, still or animated images, videos, databases, intended to be consulted by the Buyer to find out about his products and services and, if necessary, to make a purchase of the latter. The Site is accessible at the following address https://www.feed.co.)
3-6. Internet : designates different networks of servers located in various places around the world, linked together using communication networks, and communicating using a specific protocol known as TCP/IP.
3-7. Subscription : refers to the paid package offered by Feed. in order to benefit from the service aimed at receiving, each month during a period chosen by the Customer (every month or every two months), food products. The user declares that he has obtained from Feed. prior to his Order all the information on the Services and their content necessary for the Order. He declares that he is solely responsible for the choice of Services and the Subscription as well as their suitability to his needs.

Article 4. Prices

The prices of the Products offered for sale on the Site are indicated in euros including all taxes (VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding processing and shipping costs.
All orders are payable in euros (€).
Any change in the applicable VAT rate or the exchange rate may be passed on to the prices of the Products.
Similarly, if one or more taxes or levies were to be created or modified, whether upwards or downwards, this change may be passed on to the selling price of the Products on the Site.
In the event of an order to a country other than metropolitan France, the Buyer is then considered as the importer of the Product concerned, customs duties or local taxes or import duties or state taxes may then be required. These duties or taxes are the responsibility of the Buyer, both in terms of declarations and payments to the competent authorities and organizations.
The Seller reserves the right to modify at any time the prices of the Products offered for sale on the Site. The Product will be invoiced by the Vendor to the Buyer on the basis of the price list in force at the time of validation of the order and subject to availability of the Product.
The Vendor undertakes to check regularly that all prices indicated on the Site are correct, without however being able to guarantee the absolute absence of errors. If an error in the price of an item should occur, the Vendor will give the Buyer the possibility to reconfirm the purchase of the Product at the correct price or to cancel the order. In the event that the Seller is unable to contact the Buyer, the order will be considered cancelled.

Article 5. Order and Subscription

L’Acheteur a la possibilité de naviguer sur le Site et de commander des Produits proposés à la vente sur le Site, sous limite de leur disponibilité. Les Produits sont conformes aux prescriptions du droit français en vigueur au moment de leur commande par l’Acheteur. Lors d’une commande, les informations contractuelles sont présentées par le Vendeur en langue française et font l’objet d’une conformation par l’Acheteur au plus tard lors de la validation de la commande. Conformément à l’Article 6, seules les commandes comprenant un minimum de 12 repas, indépendamment du nombre de Produits, sont possibles sur le Site. Le Produit « pack découverte », comprenant 5 repas, n’est pas soumis à cette règle et peut donc être commandé seul. L’Acheteur qui souhaite acheter un Produit en passant commande doit alors remplir une fiche d’identification sur laquelle il devra indiquer les informations suivantes :
- Adresse Email
- Prénom et nom
- Adresse postale
- Numéro de téléphone
- Informations de paiement

L’ensemble des données collectées lors de la prise de commande sont traitées conformément à l’Article 15. L’Acheteur en possession d’un Compte client (voir Article 14) et souhaitant acheter un Produit en passant commande est dispensé de remplir la fiche d’identification (hors informations de paiement) et peut donc passer commande plus rapidement.
Outre la vente à l’unité, les Produits sont également proposés par le Vendeur sous forme d’abonnement périodique (ci-après l’ « Abonnement »).

5.0. La réglementation d’un abonnement à la disposition du client est la suivante :
Livraison régulière des marchandises commandées
Choix de différents intervalles de livraison (1 mois ou 2 mois)
La durée du contrat est illimitée et peut être résiliée à tout moment en nous contactant directement par téléphone au 09 70 73 18 71(du lundi au vendredi de 9h à 18h, hors jours fériés). La demande de résiliation devra être adressée à Feed. au moins 3 jours avant le renouvellement de l’abonnement pour prendre effet.
Les colis sont envoyés le même jour chaque mois, à partir du jour de la souscription de l’abonnement, à condition que ce jour ne tombe pas un week-end.

5.1. Le Client peut opter pour 2 (deux) formes d’Abonnement :
L’Abonnement mensuel à durée indéterminée ;
Lors de la souscription d’un Abonnement, il appartient au Client de s’assurer que l’Abonnement est conforme à ses besoins et choix.
L’Abonnement peut être souscrit dans le cadre d’opérations promotionnelles mises en place ponctuellement par Feed. Les conditions relatives à ces opérations sont décrites ci-dessous :

5.2. L’Abonnement mensuel à durée indéterminée
Le Client peut souscrire à un Abonnement mensuel à durée indéterminée. Dans ce contexte, il recevra les produits auxquels il a souscrit chaque mois jusqu’à dénonciation de l’Abonnement. Ce faisant, l’Abonnement est reconduit automatiquement chaque mois pour une durée supplémentaire d’un (1) mois, sauf résiliation par le Client, dans les conditions prévues à l’article 5.3. ci-après.
Le paiement de l’Abonnement sera effectué tous les mois par débit du compte personnel du Client renseigné lors de la passation de sa Commande.

5.3. Résiliation/Terme de l’Abonnement
Le Client peut mettre un terme à l’Abonnement mensuel à durée indéterminée à tout moment, ce type d’Abonnement étant sans engagement de durée, par téléphone au 09 70 73 18 71(du lundi au vendredi de 9h à 18h). La demande de résiliation devra être adressée à Feed. au moins 3 jours avant le renouvellement de l’abonnement pour prendre effet.

5.4. Modalités de paiement
En cas de souscription d’un Abonnement par le Client, les Produits seront livrés chaque mois au Client et le paiement sera prélevé à chaque début de période d’Abonnement. Le Client devra s’assurer qu’il disposera de fonds suffisants pour couvrir le règlement de l’Abonnement. S’il change de moyen de paiement en cours d’Abonnement, le Client devra s’assurer de mettre à jour ses informations sur le compte client. A défaut, l’Abonnement sera arrêté ou suspendu par le Vendeur.
En cas d’une impossibilité de débiter les sommes dues en règlement de la commande, pour quelque raison que ce soit, la commande sera annulée ou l’Abonnement arrêté ou suspendu, sans préjudice des dommages-intérêts que pourra demander le Vendeur pour indemniser son préjudice.
Le Client devra également mettre à jour son adresse en cas de déménagement en cours d’Abonnement. Le Vendeur ne sera pas responsable si le Client ne met pas à jour son adresse en cas de déménagement. Les frais de seconde livraison de toute commande, au titre d’un Abonnement, qui devra être renvoyée en raison de l’absence de mise à jour de son adresse de livraison par le Client, seront facturés au Client.Le paiement des Services se fait par carte bancaire (Bleue, Visa, Mastercard). Les paiements effectués seront sécurisés par une procédure de cryptage des données en vue d’éviter l’interception de ces informations par un tiers.
Les paiements effectués par le Client sont considérés comme définitifs après encaissement effectif des sommes.
Feed. ne saurait être tenue responsable en cas d’usage frauduleux des moyens de paiement utilisés sur le Site ou en cas d’erreur due au système de paiement.
Chaque Renouvellement est conditionné au prélèvement du montant correspondant à l’abonnement sur le compte bancaire du Membre.
En cas de refus de prélèvement, pour quelque cause que ce soit, le Membre devra régulariser sa situation. A défaut, le Renouvellement suivant ne pourra pas être assuré et le Service sera suspendu par Feed.

Article 6. Validity and validation

Any order of Products on the Site by the Buyer implies the full and complete adhesion of the Buyer and the Seller to the present General Conditions of Sale, without exception or reserve. Only orders with a minimum of 35€ can be validated. The "Pack" products, comprising an assortment of products, is not subject to this rule and can therefore be ordered alone. A summary of the order of Products is communicated by the Seller to the Buyer on the e-mail address indicated on the identification form of the Buyer during the order. The summary of the Product order includes the following information:
- a summary of the Products ordered,
- the price,
- the date and time of the order,
- the date or time by which the Seller undertakes to deliver the goods, the delivery costs,
- the method of payment chosen by the Buyer,
- the withdrawal period from which the Buyer benefits, as well as the form allowing him/her to exercise it.

The Buyer must check the contents of the summary as soon as possible and immediately notify the Seller of any errors or omissions. The confirmation of the order is equivalent to the signature and acceptance of the transaction by the Buyer and the Seller. The recorded confirmation of the order for products and all the data transmitted during the order shall constitute proof of the transaction in accordance with the provisions of Law No. 2000-230 of 13 March 2000 adapting the law of evidence to information technologies and relating to electronic signatures, and shall constitute payment of the sums involved in the order. However, in the event of fraudulent use of his/her bank card, the Buyer is invited to contact the Seller's customer service as soon as possible. It is expressly agreed that, except in the event of an obvious error on the part of the Seller, the data stored in the Seller's computer systems, under reasonable security conditions, have evidential value with regard to the orders placed by the Buyer. Data on computer or electronic media constitute valid evidence and as such are admissible under the same conditions and with the same probative force as any document that would be established, received or kept in writing. The Seller undertakes to honour orders for Products received on the Site and validated only within the limits of available stocks of products. In the event that the Products are not available, the Seller undertakes to inform
as soon as possible in accordance with Article 8. The Seller reserves the right to refuse any order if the quantities of products ordered are abnormally high for Buyers who are consumers.

Article 7. Payment

The validation of the order of Products implies for the Buyer the obligation to pay the price indicated on the order confirmation. The Buyer must pay for his/her purchases online at the time of ordering by credit card (Carte Bleue, e-carte bleue, Visa, Eurocard, Mastercard) or by Paypal, a highly secure web payment infrastructure certified PCI level 1. 

The Buyer also has the possibility to choose payment in three instalments via ALMA from 99€ onwards, only for France and excluding subscriptions.
If the Buyer wishes to pay for his order in several instalments, he accepts Alma's General Terms and Conditions of Use and you confirm that you have read Alma's Privacy Policy.

Article 8 - availability

The Products are offered by the Seller on the Site within the limits of available stocks and their possible expiry date. For Products not in stock, offers are valid subject to availability. In case of unavailability of a Product after placing and validating an order, the Seller will inform the Buyer by e-mail as soon as possible. The Buyer's order may then, according to his wishes, be cancelled and no bank debit will then be made by the Seller, or put on hold while the Seller restocks the Product.

Article 9. Transfer of ownership

The products remain the entire property of the Seller until full payment of the price by the Buyer. The transfer of ownership of the pre-ordered or ordered Product takes place at the time of the physical transfer of the Product to the Buyer, the risks of loss or damage to the Products are then also immediately transferred from the Seller to the Buyer.

Article 10. Delivery

Delivery is made to the address indicated in the Buyer's order form. The Buyer must indicate very precisely his address and his postal code as well as any other relevant indication for the delivery without using any abbreviation. Only deliveries within the European Economic Area are possible. If you wish to have your order delivered outside the European Economic Area, the Buyer is invited to contact the Seller. The delivery times indicated on the Site are the usual average times. The Seller shall endeavour to respect these times. The shipping time of the order varies according to the method of Delivery chosen by the Buyer. The products are delivered by the Seller to the delivery address indicated by the Buyer during the ordering process, within the time indicated on the order validation page. In case of delay in shipping, an email will be sent to the Buyer to inform him of a possible consequence on the delivery time indicated. The cost of delivery for France is set at 7.90€ per order, regardless of the number of Products concerned and the delivery address indicated in the Purchaser's order form. Deliveries are offered in France from 70€ of purchases and in the rest of the European Economic Area from 70€ of purchases. A specialized logistician is in charge of deliveries, in order to ensure the best possible service. After the payment of the order, the latter will send to the Buyer an e-mail with the tracking number of the parcel to the indicated e-mail address. In case of abusive delay of delivery, the Buyer has the possibility to cancel the order in the conditions and modalities defined in the article L 216-2 of the Code of the Consumption. If meanwhile the Buyer receives the product, he will have to return it to the Seller in its original packing and without deterioration as soon as possible. In case of delivery by carrier, the Seller cannot be held responsible for any delay in delivery due exclusively to the Buyer's unavailability after several proposed appointments. At the time of delivery of the Product, the Buyer is required to verify:
That the number of packages delivered corresponds to the indications on the transport document and the invoice;
That the packaging is intact, undamaged, not wet or altered in any way, including the materials used to close the package.
The Buyer shall immediately report any damage to the packaging and/or the Products or an error in the number of packages or non-conformity of the indications, by placing a written control reservation on the Delivery receipt. After signing the delivery slip, the Buyer shall not be entitled to object to the external appearance of the delivery. In the event of delivery by parcel post, the Seller shall apply the rates in force at the time of the order.

Article 11. Resolution

The order of Products can be resolved by the Buyer in case of:
- Delivery of a product that does not comply with the declared characteristics of the product;
- Price increase that is not justified by a technical modification of the product imposed by the public authorities.
The order of Products may be cancelled by the Buyer in case of:
- Delivery exceeding the deadline set in the order form or, failing such a date, within thirty days of the conclusion of the contract, after the Vendor has been enjoined, according to the same terms and without result, to make the Delivery within a reasonable additional period;
The order of Products may be cancelled by the Vendor in case of:
- Refusal by the Buyer to take Delivery;
- Non-payment of the price at the time of the validation of the order.

Article 12. Withdrawal

In accordance with article L. 221-18 of the French Consumer Code, the Buyer has a period of fourteen (14) days from the date of receipt of the Products ordered to withdraw from the contract without having to give any reason or pay any penalty, with the exception of the return costs, which are at the Buyer's expense.
If the parcel has not been collected by the Buyer from the collection point, a €9.90 return fee (payable by the Buyer) will be deducted from the refund.
To exercise his/her right of withdrawal, the Buyer must inform the Seller by email (service.clients@feed.co) or by using the online contact form (here).
In the case of an exchange of Products, reshipment will be at the Buyer's expense: a promotional code for the amount of the returned Products will then be sent to the Buyer's email address so that the Buyer can recommend the desired Products in place of those returned.
All returns must be notified in advance to the Vendor's customer service department:
- by email: service.clients@feed.co
- by telephone: +33 970 731 871 (price of a local call)
Returns must be made in their original and complete condition (products, packaging, accessories, instructions), with the purchase invoice, as soon as possible and, at the latest, within fourteen days of notification of the decision to withdraw. Returns must be sent to the following address: FEED, chez YOUFIRST, 159 Avenue Charles de Gaulle, 92200 Neuilly-sur-Seine.
Any damage suffered by the product during its return is the responsibility of the Purchaser and may be such as to defeat the right of withdrawal. The right of withdrawal may only be exercised in respect of the entire order.
If all the above conditions are met, the Vendor will reimburse the Buyer for all sums paid, including delivery costs (standard delivery costs if invoiced on the order), upon receipt of the returned goods. The refund will be made using the same means of payment as that used by the Buyer for the initial transaction, unless the Buyer expressly agrees to use another means of payment, and insofar as the refund does not incur any costs for the Buyer. On the other hand, the Vendor is not obliged to reimburse additional costs if the Buyer has expressly chosen a more expensive delivery method than the standard one proposed by the Vendor.
In accordance with article L.221-28 of the French Consumer Code, the right of withdrawal provided for in the case of distance selling cannot be exercised in particular for contracts:
- For the supply of goods likely to deteriorate or expire rapidly;
- For the supply of goods which have been unsealed by the Buyer after Delivery and which cannot be returned for reasons of hygiene or health protection.
As labelling clearly establishes the presence or absence of allergens, the Company cannot be held responsible for any error made by the Buyer concerning his or her intolerance or allergy to certain ingredients. Intolerance or allergy cannot therefore be used as a basis for reimbursement outside the legal withdrawal period.
Orders may not be cancelled unless the right of withdrawal is exercised in accordance with the above conditions.

Article 13. Guarantees

All Products offered to order by the Seller on the Site benefit from the legal guarantee of conformity and the guarantee against hidden defects. All claims, requests for exchange or refund must be made by post within 30 days of delivery. The products must be returned to us by the Buyer in the state in which he received them with all the elements (accessories, packaging, instructions...), as well as with the invoice justifying the payment. The shipping costs will be reimbursed to the Buyer by the Seller on the basis of the invoiced price and the return costs will be reimbursed to the Buyer by the Seller on presentation of the supporting documents. The provisions of this article do not prevent the Buyer from benefiting from the right of withdrawal provided for in Article 12.

Article 13.1. Warranty against hidden defects

The Products offered on the Site are subject to the guarantee against hidden defects set out in articles 1641 and following of the Civil Code: Article 1641 of the Civil Code: "The Seller is bound by the guarantee on account of the hidden defects of the thing sold which render it unfit for the use for which it is intended, or which so diminish this use that the Buyer would not have acquired it, or would only have paid a lower price for it, if he had known about them. "The action resulting from latent defects must be brought within two years from the discovery of the defect.

Article 13.2 Legal guarantee of conformity

The Products offered on the Site are also subject to the legal guarantee of conformity provided for in Articles L.217-4 and following of the Consumer Code: Article L.217-4 of the Consumer Code: "The Seller delivers a good in conformity with the contract and is liable for any defects of
conformity existing at the time of delivery. He shall also be liable for defects of conformity resulting from packaging, assembly instructions or installation when the latter has been made his responsibility by the contract or has been carried out under his responsibility. "The action resulting from the lack of conformity shall be time-barred within two years of delivery of the Product. The legal guarantee of conformity applies independently of any commercial guarantee.

Article 14. Customer account

The Buyer, if he wishes, can create a customer account allowing him to access many advantages: order faster, register different addresses, track his orders ... To create a customer account, the Buyer must fill in the following information:
- First and last name
- Email address
- Choice of a password

The Buyer has the possibility to create an account with his Facebook or Google account. All data collected during the creation of the customer account are processed in accordance with Article 15. The Buyer with a customer account is obliged to connect to it to place an order for Products on the Site. In addition, in accordance with Article 15 and the Vendor's Privacy Policy, a customer account is automatically created for any Buyer placing an order for Products who does not yet have a customer account. This customer account will then be essential for all future orders of products. If the account becomes inaccessible to its holder, the latter will be able to report it to the Seller's services by contacting customer service.

Article 15. Personal data

In accordance with the law relating to data processing, data files and liberties of 6 January 1978 and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, the Buyer's information of a personal nature may be subject to automated processing by the Seller. The processing of certain personal data of the Buyer is mandatory to take order of the Products, but also to create a customer account and to subscribe to the newsletter. For more information on the processing of the Buyer's personal data, the Buyer is invited to consult the Vendor's Privacy Policy (here) which is an integral part of these General Terms and Conditions of Sale.

Article 16. Cookies

During his navigation on the Site, the Buyer is led to consent to the use of cookies by the Seller. For more information on cookies, the Buyer is invited to consult the Vendor's Privacy Policy (here) which is an integral part of these General Terms and Conditions of Sale.

Article 17. Intellectual Property

All elements of the Site, whether visual or audio, including software, all intellectual property rights such as trademarks, service marks, shape marks and copyrights are and remain the exclusive property of the Seller. Unless otherwise stated, the intellectual property rights on the documents contained on the Site and each of the elements created for this Site are the exclusive property of the Vendor, who does not grant any licence or any other right other than that of consulting the Site and placing an order for Products. The reproduction of any page or content of the said Site by the Buyer or any third party is subject to prior written authorisation from the Seller. The reproduction of any documents published on the Site is only authorized for the exclusive purpose of information for personal and private use, any reproduction and any use of copies made for other purposes being expressly prohibited by the Vendor. It is forbidden to use the brands, images or any other element on which the Vendor holds intellectual property rights. It is also forbidden to copy, modify, create a derivative work, reverse the design or assembly or in any other way attempt to find the source code (except as provided by law), sell, assign, sub-license or transfer in any way whatsoever any right relating to the Site. It is furthermore forbidden to modify the Site or to use modified versions of the Site and in particular (without this enumeration being restrictive) in order to obtain unauthorized access to the Site and to access the Site by any other means than through the interface that is provided to the Buyer by the Seller for this purpose. The Site as well as any possible software necessarily used in connection with it may contain confidential information protected by the intellectual property rights in force or any other law. The Buyer who has a personal website and who wishes to place, for personal use, on his site a simple link referring directly to the Vendor's site, must obligatorily request prior written authorisation from the Vendor, who reserves the right to refuse it without any specific reason. In any case, any unauthorized link must be removed at the Seller's request.

Article 18. Responsibility

The Products comply with the French legislation in force. The Seller shall not be held liable in the event of failure to comply with the laws in force in the third country where the Products are delivered. It is up to the Buyer to check with the local authorities the possibilities of importing or
using the pre-ordered or ordered Products. The Vendor shall not be held liable for any damage resulting from misuse of the Product by the Buyer or by any third party. The nutritional composition of each Product being clearly displayed on the Site, on each order and on the Products, the Vendor shall not be held liable for any intolerances or allergies of the Buyer. The Vendor shall not be held liable for any inconvenience or damage inherent to the use of the Internet, in particular a break in service, external intrusion or the presence of computer viruses. The same applies to potential hypertext links present on the Site. Finally, the responsibility
of the Seller could not be engaged in the case where the non-performance of its obligations would be attributable either to the unforeseeable and insurmountable fact of a third party to the contract or to a case of force majeure as defined by French jurisprudence, or because of the Buyer (Article L. 221-15 of the Consumer Code).

Article 19. Force majeure

In the event of the occurrence of an event of force majeure or fortuitous event, due to the other party or a third party or external causes such as social conflicts, intervention by civil or military authorities, natural disasters, fire, water damage, interruption of the telecommunications network or the electricity network, without this list being exhaustive, the Buyer's or Seller's liability cannot be sought if the execution of the contract is delayed or prevented.

Article 20. Archiving and proof

The Seller shall archive purchase orders and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of Article 1360 of the Civil Code. The Seller's computerized registers shall be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.

Article 21. Litigation

In the event of a dispute, the Buyer must first contact the Seller's customer service by e-mail (service.clients@feed.co) or post (231 rue saint honoré 75001 PARIS). In the event of failure to make a claim to the customer service department or in the absence of a response within two months, the Buyer may submit the dispute opposing the Seller to FEVAD's E-COMMERCE MEDIATOR SERVICE (http://www.mediateurfevad.fr/), which will attempt, with complete independence and impartiality, to bring the parties together with a view to reaching a solution. The Buyer and the Seller remain free to accept or refuse recourse to the settlement of a dispute through mediation as well as to accept or refuse the solution proposed by the mediator. In the absence of an amicable agreement, the competent court for resolving the dispute shall be that of the place of domicile of the defendant or that of the place of actual delivery of the Product. The language of these General Terms and Conditions of Sale is French. The present General Terms and Conditions of Sale are therefore subject to French law.

Article 22. Duration

The present terms and conditions shall apply for the entire duration of the online publication of the Products offered for sale by the Seller.

Article 23. Domiciliation

The parties elect domicile at the addresses indicated on the order form for the Buyer and at the address appearing on the site for the Seller.

Article 24. Nullity

If any of the clauses of the present General Terms and Conditions of Sale should prove to be null and void with regard to a rule of law in force or a judicial decision that has become final, it shall then be deemed to be unwritten, without however entailing the nullity of the General Terms and Conditions of Sale as a whole or altering the validity of its other provisions.
